Whatever year it was built, UP doesn't want any liability regarding people repainting that Evanston viaduct even if they did it for free. It means the UP's shysters shut it down! I can tell that while you may know when the bridge was built, you don't know anything about the applicable law. Look up the Rachel Barton Pine case on what Metra and UP would have to pay. As far as the waiver, it is no good against gross negligence, undisclosed conditions, and risks not expressly assumed. There's a famous case of someone poisoned rehabbing a Boston streetcar bought as is whose estate sucessfully sued. The only thing I can conclude is that whatever the competence of the people running the CRD of RTA d/b/a METRA and UP, everyone else is glad you aren't doing it.
